Elia Baltazar works in Mexico-city, which is quite safe for journalists. But she told that small towns are very dangerous to work in. The problem of the small towns is that people there are quite poor. And there is also a lot of drug trafficking. That’s why the law is not respected there. Criminal groups are the real power.

If journalists write about criminal cases, drugs or corruption, they can get killed. For example, Regina Martínez, who often wrote about corruption and drug cartels in Veracruz, was murdered on April 29. She was killed two weeks after publishing an article about corruption in the police force and relations between police and drug criminals. She was killed in her own apartment, some days before she got threats, but she didn’t pay much attention to it.

There are many other examples. In the past year, at least three journalists have been found dead in Veracruz on the east of Mexico, including Martínez.

In July 2011, a reporter on police matters for the newspaper Notiver, Yolanda Ordaz de la Cruz, was found with her throat cut.

A month earlier, Miguel Velasco, a columnist and deputy editor, was killed. He was shot together with his wife and one of his children.

According to the National Human Rights Committee, around 74 journalists were killed in Mexico during the last 10 years, but none of the killers has been found yet. According to Elia’s information, nobody is in jail. ‘It’s very hard to determine who is an enemy: the drug mafia, authorities, gangs, or are they all the same enemy? So you never know whom you should fight against.’

Journalists have no support from the government, neither from employers (journalists don’t have any agreements with employers or documents which would protect their rights or provide them with social support).

To the question, why people become journalists in Mexico, Elia answered, that someone should report about the problems. “We must try to change the situation. If we don’t, who does?” Journalism is one of the most dangerous professions in Mexico.

Op deze Avond van de Persvrijheid beantwoordt ze via een Skype-verbinding alle vragen van het publiek en vertelt ze haar eigen verhalen. Verhalen die in Mexico verteld worden aan Marjon, maar uit angst voor de machtige drugkartels verder geheim gehouden worden. ‘Dat de persvrijheid de afgelopen jaren achteruit is gegaan hier, dat is het verhaal dat ik wil vertellen,’ vertelt Marjon. ‘Criminele organisaties controleren op hun eigen manier de persvrijheid. Heel Latijns-Amerika is democratisch. Althans, officieel. Je weet hier niet precies wat je wel mag zeggen.’

Het thema van de Dag van de Persvrijheid staat dit jaar in het teken van Untold Stories. Marjon hoort dit soort verhalen dagelijks. Op bezoek bij een lokale redactie vertelde de redacteur van de krant haar dat hij al jaren niet meer over geweld schreef. ‘Voor zijn deur lagen kortgeleden nog drie lijken, maar daar schreef hij niets over. Een paar dagen daarna werd de redactie alsnog overvallen en werd er op iedereen geschoten. Hij vertelde: blijkbaar heb ik toch iets verkeerd geschreven, misschien per ongeluk over een auto-ongeluk.’

De autoriteiten zijn vaak ook corrupt. ‘Het heeft geen zin om naar de politie te stappen. Die zit daar zelf ook diep in.’ Marjon legt uit dat de keuze van een Mexicaanse inwoner vaak simpel is. ‘Het geld of de kogel. Er is bijna geen ontsnappen meer aan. Ze weten je familie toch wel te vinden.’

Persvrijheid is in een land als Mexico ver te zoeken. Niet alleen de burgers staan doodsangsten uit, ook de waakhonden van de democratie kunnen hun werk niet veilig uitoefenen. Vorige week is journaliste Regina Martez om het leven gebracht. Mexico staat op de 149^e plaats in de Press Freedom Index van 2011-2012. Van de 179 landen is het één van de gevaarlijkere landen.

‘Er wordt voorzichtiger met iemand omgegaan wanneer ze media-aandacht krijgen.’ Op de vraag of zij denkt dat de journalistiek een oplossing kan zijn voor de problemen met de persvrijheid in Latijns-Amerika, reageert Marjon enthousiast. ‘Ja, anders zou ik er niet zo idioot mee bezig zijn. Informatie is ontzettend belangrijk, het beschermt mensen.’

‘The only way to go would be to abolish Article 301,’ Çongar says. ‘It is truly a disgrace that this law still exists.’ Penal Law Article 301, making any insult of Turkey or the Turkish state illegal, is seen as the biggest obstacle for press freedom in Turkey. Çongar however, explains that in the recent past this article has been slightly changed. Now, if the state wishes to try someone on Article 301, it should first obtain written permission of the Minister of Justice. ‘This means that this important and dangerous decision is up to the random judgment of one person.’ This doesn’t seem like a very transparent way to deal with press freedom.

A top-down decision to abolish this law seems unlikely in the near future. Bottom-up expressions of the public, however, might be able to exert influence. Taraf plays a big part in this. ‘Readers’ responses to Taraf are very strong.’ Yasemin states. ‘Taraf is a small newspaper, but has big impact in public opinion and political discussion.’ Çongar explains how the newspaper is meant for anyone and everyone: it is read by liberal students in Istanbul, as well as middle-aged conservatives in Central Anatolia or Kurdish readers. ‘It has many enemies as well, but if it would cease to exist – it will be greatly missed,’ Çongar claims.

Even though advertisers are not very interested in Taraf, Çongar praises her ‘stubborn’ publisher and her ‘stubborn’ staff for keeping the newspaper alive. ‘We have very little means, but strife for a goal.’ Congar states. She praises Taraf’s journalists, mostly young beginning writers, for persisting; ‘even when they’d lost a lot of money or were not paid for months.’ According to Çongar, this is part of the job as a journalist in Turkey. ‘Working in these situations is nothing to envy, but I never regret my decision. I have made a choice, to be a journalist, to be part of Taraf. This newspaper is making an impact and changing the country,’ she says.

Cees is one of the journalist, who doesn’t is afraid to do his job in this country. First of all it connected with the place, where he lives. It is Mexico-City, and that is one of the most saver parts of the country. Secondly Zoon looks like a tourist. And to be a ‘tourist’ is much more save in Mexico than to be a journalist. “I think that the matter of last two years, that appears some in regions, where better not to go”.
Zoon prefers to write about the culture, but such kinds of stories are not sold that good. So his last story was about drug problems in the area, which used to be a paradise with beautiful architecture and nice atmosphere. But now after the murder one of the narco-barons, cartels started to fight for the power. So every night shooting turns previous heaven to hell.

To make such story wasn’t that easy. It goes without saying that only few persons can afford themselves to talk in front of the camera. But to make an interview even with foreign journalist is a big challenge. That tells about the level of fear among the population of the country. But not only the fear is the obligatory attribute of the Mexican, another one is drugs of course.

Drug topic had assimilated in everyday life of each person. And that was one of the subjects in Zoon’s book about Mexico, which was recently published. Other chapter was dedicated to the journalists.

Press situation in Mexico

In Zoon’s opinion less journalists writes critically about the reality in Mexico. Self-censorship is very well spreaded in the country: “they don’t write everything they know anymore”. But still there are some groups of journalists who try to be totally honest with the audience. There is a tandem of 3 journalist of one newspaper who find a lot of bad real stories and “dare” to publish their articles signed (that is not so popular nowadays in Mexico). But on the other hand there are some journalists who’s behavior is provocative. And they play with their lives themselves.

Zoon thinks that the only chance to change the situation in the country and in journalism is to legalese drugs. In three months there are elections in Mexico. Who knows, maybe after that the situation will become better.

De twee journalisten zijn inmiddels het symbool geworden van de dalende persvrijheid in Turkije, 1 van de twee hoofdthema’s dit jaar.

Zaak Ergenekon
Ruim een jaar geleden werden de twee samen met nog tien anderen journalisten opgepakt in de zaak Ergenekon, een organisatie binnen het overheidsapparaat en het leger die van plan zou zijn geweest de regering van premier Erogan ten val te brengen. Hen werd steun aan een gewapende organisatie ten laste gelegd.

‘Het leger van de Imam’ 
De onderzoeksjournalisten deden onderzoek naar netwerken binnen de overheid en publiceerden daar opschuddende werken over. Het boek waar ze al hun bevindingen in beschreven, ‘Het Leger van de Imam’, werd nooit gepubliceerd, maar zorgde desalniettemin voor veel opspraak in Turkije.

Inmiddels zijn ze vrijgelaten, maar de rechtszaak is nog niet afgesloten. Er hangt ze nog steeds een celstraf van 15 jaar boven het hoofd.

Many things are nowadays changing in Spain. People are not only suffering a economic crisis; people are being affected by a crisis in one of their fundamental human right:, their right of express in a free way. The new Spanish government is taking some controversial measures related with media that have caused a great impact in the country. Is Spain walking backwards?

Spanish Ministry of Interior plans reform the penal code to become “passive resistence” in a crime.

The Spanish minister of the Interior has announced recently that the Executive is going to carry out a far-reaching reform of the penal code. These measures will include as a “crime of integration in a criminal organization” call violent gatherings by Internet. It could be condemn under penalty of jail. Spanish Government justify this action saying that they must fight against “the spiral of violence” of some “anti-system communities”.

However the Internet calls are not the only affected by the reform that is considered for many people a restriction of  their rights. It will be considered like crime or assault against authority the big, passive or active, resistance. That means that everybody who attends to a demonstration which had not been notified before to the Delegation of Government could be convicted.

The government also is going to tougher sanctions for street violence, equating it with the antiterrorism legislation specially designed for the cases of “Kale Borroka” (actions carried out by the supporters of the group terrorist ETA in Basque Country). The objective of all of this is, according with the  Spanish Prime Minister, Mariano Rajoy, “strengthen the authority” to ensure the public order.

Spanish Public Media (RTVE) don´t escape neither of these temperamental decisions.

The party in the power plans change the the way that the president of RTVE is elected. Until the arrive of the new Government in Spain the model of govern of the  Spanish Public Television consisted on a board of directors whilst of 12 individuals was to be elected on the merits of outstanding qualifications and professional experience.

Eight of the members were to be appointed by Parliament by two-thirds majority, with two of those being nominated by the majority union within RTVE Corporation. The remaining four were to be appointed by the Senate, also by two-thirds majority.

The president of RTVE Corporation and of the board of directors was to be appointed by Parliament, chosen from among the twelve elected board members. This model guaranteed (more or less) the independence of the press from the government.

Now the election of President of RTVE will not need consensus among the majority parties.  With the reform, there will be a first ballot that will look for the agreement of two thirds of the Congress. If this not happens, there will be a second ballot in which an absolute majority is enough: 176 of 350 deputies.

We must not forget that People Party obtained absolute majority in the past elections so they will be able to chose the new president of the national public radio and television without pact with other parliamentary groups.

With a “head of public media” chosen by the government, who can guarantee the freedom of the press?. How many parts of the stories will be able to be lost?

Çongar begon op haar zeventiende in de journalistieke wereld. Na werkzaamheden voor de BBC in Londen en als correspondente voor Milliyet in Washington, keerde zij terug naar Turkije om hier een tegengeluid te geven binnen de Turkse media, die voornamelijk de wensen van de overheid en het leger uitdragen. Zij streeft naar het creëren van echte, eerlijke journalistiek en richtte voor dit doel in 2007 met Ahmet Altan de onafhankelijke krant Taraf op.

Een moedige stap in een land dat volgens Işıl Karakaş, rechter van het Europese Hof van de Mensenrechten, het Europese land met de meeste meldingen van persvrijheidsschendingen is. In 2011 waren dit er 200. Bovendien is persvrijheid in Turkije wettelijk aan banden gelegd, middels Artikel 301 van het wetboek van strafrecht. In 2005 werd deze wet aangenomen en sindsdien is het beledigen van Turkije of de Turkse staat illegaal. Journalisten zijn hierdoor met handen gebonden; zelfcensuur en anonieme publicaties zijn aan de orde van de dag.

Çongar poogt met Taraf verandering in gang te zetten door controversiële verhalen te publiceren over bijvoorbeeld de rol die het Turkse leger in de politiek speelt. Dit wordt de journaliste niet in dank afgenomen. Çongar en de haren zijn meerdere keren bedreigd, evenals voor het gerecht gesleept. Ook is het een hele uitdaging Taraf gaande te houden: adverteerders staan niet te springen het te financieren en vervolgens haken medewerkers van de krant snel af wanneer zij geen inkomsten krijgen. Toch zorgt slechts de aanwezigheid van dit onafhankelijke nieuwsmedium voor een toenemende druk op de situatie in Turkije.
